ESDM Ministerial Regulation 12/2026: priority mining areas (WIUP/WIUPK), community mining areas and permits
- Amends ESDM Ministerial Regulation 18/2025 on the conduct of mineral and coal mining business; signed by the ESDM Minister on 8 October 2026.
- Priority awards of mining areas (WIUP/WIUPK) are assessed on: geological potential, proximity of the resource to local communities, job creation in the region, economic benefit to communities, and support for domestic value-adding (downstreaming).
- Priority applications for metal mineral or coal WIUP are verified through the ministry's official channels and the OSS system within 14 calendar days of filing.
- Community mining areas (WPR) are proposed by governors, up to 100 hectares per block, with primary metal mineral reserves no deeper than 100 metres.
- Community mining permits (IPR) are issued by governors: up to 5 hectares for individuals and 10 hectares for cooperatives; governors also supervise safety and post-mining recovery.

ESDM Ministerial Decree 365.K/MB.01/MEM.B/2026: using subsidiaries or affiliates as mining contractors requires ministerial approval
- IUP/IUPK holders may not involve their subsidiaries and/or affiliates in mining services without official approval from the ESDM Minister.
- Affiliation covers direct shareholding between the IUP/IUPK holder and the mining-services (IUJP) company, and sharing one or more beneficial owners.
- Approval is only available to holders carrying out special government assignments: building processing/refining facilities (downstreaming) and developing or using coal, national strategic projects, or meeting domestic mineral or coal needs.
- Applications are processed within 14 working days of a complete and correct file; holders whose IUP was issued by a governor apply to that governor.
- Also applies to IUPK holders continuing former contracts, Contracts of Work (KK) and coal contracts (PKP2B). Revokes Director-General Regulation 376.K/30/DJB/2010. Signed on 18 September 2026.
